Access Regulations of Special Automotive & Trailer Enterprises and Products
Chapter 1 General Provisions
Article 1 This Regulation is formulated with a view to specifying access regulations of special automotive & trailer enterprises and products, maintaining market competition order of special automotive & trailer products, pushing automobile industry structure adjustment, optimization and upgrade, and facilitating enterprise technical progress in accordance with the relevant requirements of "Decision of the State Council on Establishing Administrative Licenses for Administrative Examination and Approval Items Really Necessary to be Retained" and "Automotive Industry Development Policy".
Article 2 This Regulation is applicable to the enterprises (hereinafter referred to as "special vehicle manufacturers") engaged in the manufacturing of special automotive & trailer products (hereinafter referred to as "special vehicle products") used domestically within the territory of the People's Republic of China and to special vehicle products produced by them.
Special automobile concerned in this Regulation refers to the vehicles manufactured based on procured complete vehicle or Category II and Category III chassis, and defined in Article 2.1.1.11, Article 2.1.2.3.5 and Article 2.1.2.3.6 in the national standard GB/T 3730.1-2001 "Motor Vehicles and Trailers-Types-Terms and Definitions". Trailer refers to semitrailer and centre axle trailer defined in Article 2.2.2 and Article 2.2.3 in the national standard GB/T 3730.1-2001 "Motor Vehicles and Trailers-Types-Terms and Definitions".
Category II chassis concerned in this Regulation refers to incomplete vehicle with cab, engine, driving system, running system, steering system, brake system and main electrical equipment but without goods carrying device or dedicated device.
Category III chassis concerned in this Regulation refers to incomplete vehicle with engine, driving system, running system, steering system, brake system and main electrical equipment but without cab (or vehicle body), goods carrying device or dedicated device.
Article 3 Ministry of Industry and Information Technology is responsible for implementing the permission of special vehicle manufacturers and special vehicle products.
Article 4 The nation encourages and gradually carries out the complete automobile (including chassis) manufacturer shall conduct unified management for special automobile manufacturers who adopt the product of such manufacturer to conduct follow-up manufacturing and for special automobile products.
