Provisions on Major Responsibilities of Shandong Production and Operation Entities
Article 1 The Provisions are formulated by combining with actual conditions of the province and in accordance with the "Production Safety Law of the People's Republic of China", the "Regulations on Safety Production in Shandong Province" and relevant laws and regulations in order to implement major responsibilities of production and operation entities for safety production, prevent and reduce production safety accidents, ensure life & health and property safety of the people and promote the harmony development of the economy and society.
Article 2 For the production and operation entities fulfilling the major responsibilities of safety production in the administrative area of this province, the Provisions apply unless otherwise stated in the laws, regulations and rules.
Article 3 The term "production and operation entities" named in the Provisions refers to enterprises, public institutions and individual economic organizations etc. engaging in the production or operation activities.
Article 4 The production and operation entities are responsibility subjects of the safety production and take the subject responsibilities for the safety production of their entities. The major responsibilities of the subject include organization assurance responsibility, rules and regulations assurance responsibility, material & funds assurance responsibility, management assurance responsibility and accident report and emergency rescue responsibility.
Article 5 The safety production supervision and administration departments of the people's governments at or above the county level make a comprehensive supervision and administration for the production and operation entities in fulfilling major responsibilities of safety production according to the laws; the supervision and administration departments for safety production are responsible for the supervision and administration for production and operation entities in fulfilling major responsibilities of safety production within their responsibility scope.
Article 6 The production and operation entities shall establish and improve safety production responsibility system, implement safety production responsibility system of the entire personnel, define the safety production responsibilities of all the practitioners of production and operation entities such as the principal, other responsible persons, the responsible persons in functional departments, production workshop (team) and production team and the ordinary practitioner; moreover, the mentioned above shall be implemented and assessed level by level. The assessment result will be regarded as the important basis for the practitioners in regularization of employment and distribution of incomes.
