Article 1 With a view to strengthening production management of commercial cryptographic products and regulating production activities of commercial cryptographic products, the Regulations is hereby formulated in accordance with Regulations on Administration of Commercial Cipher Codes.
Article 2 The term "commercial cryptographic products" as mentioned in the Regulations refers to products for encipherment protection or security certificate on the information not involved in state secrets by using cryptographic techniques.
Article 3 For the purpose of the Regulations, the production activities of commercial cryptographic products apply. The production of commercial cryptographic products mentioned in the Regulations includes research and development of commercial cryptographic products.
Article 4 Commercial cryptographic products are produced by the unit designated by the State Cryptography Administration (hereinafter referred to as designated producer of commercial cryptographic products). Any unit or individual, without designation, shall not produce such products.
The variety and model of commercial cryptographic products must be approved by the State Cryptography Administration.
Article 5 The State Cryptography Administration is responsible for the production management of commercial cryptographic products throughout the country.
The cryptography administration organizations of provinces, autonomous regions and municipalities directly under the Central Government shall undertake relevant administrative affairs in accordance with the Regulations.
Article 6 The State Cryptography Administration designates producers of commercial cryptographic products based on the development demand of commercial cipher codes.
The designated producers of commercial cryptographic products must have independent legal person qualification, have the technical strength and place to adapt to the development and production of commercial cryptographic products, have the equipment, production process and quality assurance system to ensure the quality of commercial cryptographic products, and meet other conditions specified in the legal and administrative regulations.
Article 7 The State Cryptography Administration shall regularly designate the producers of commercial cryptographic products in a centralized manner in principle.
The designation procedure for designated producers of commercial cryptographic products is as follows:
(I) the applicant unit fills in "Application Form for Designated Producer of Commercial Cryptographic Products" and submits it to the local cryptography administration organizations of provinces, autonomous regions and municipalities directly under the Central Government;
(II) the cryptography administration organizations of provinces, autonomous regions and municipalities directly under the Central Government conducts preliminary examination on the written material submitted by the applicant unit and gives preliminary examination opinion;
(III) the State Cryptography Administration conducts on-the-spot investigation for the unit passing the preliminary examination;
(IV) the State Cryptography Administration makes the designation decision and informs the designation result.
Article 8 The State Cryptography Administration issues "Certificate for Designated Producer of Commercial Cryptographic Products" to the designated producer of commercial cryptographic products and promulgates it.
"Certificate for Designated Producer of Commercial Cryptographic Products" is valid for 3 years.
Article 9 The designated producer of commercial cryptographic products shall, within 30 days from the date of obtaining "Certificate for Designated Producer of Commercial Cryptographic Products", transact registration formalities of licensing project at the local industrial and commercial administrative department.
