Chapter I General Article 1 This law is enacted with a view to protecting and improving ecological environment, preventing and controlling environmental pollution caused by solid waste, ensuring the public health, safeguarding ecological safety, promoting the ecological civilization construction and the sustainable development of economy and society. Article 2 This law is applicable to the prevention and control of environmental pollution caused by solid waste. This law is not applicable to the prevention and control of marine environmental pollution caused by solid waste or of environmental pollution caused by radioactive solid waste. Article 3 The State implements the green development mode, promotes the development of cleaner production and circular economy. The State advocates a simple and moderate, green and low-carbon lifestyle, and guides the public to actively participate in the prevention and control of environmental pollution caused by solid waste. Article 4 For the prevention and control of environmental pollution caused by solid waste, the principles of reduction, resource utilization and harmlessness shall be adhered to. All entities and individuals shall take measures to reduce the amount of solid waste, and promote its comprehensive utilization and reduce its harmfulness. Article 5 For the prevention and control of environmental pollution caused by solid waste, the principle of responsibility for the pollution shall be adhered to. Entities and individuals that generate, collect, store, transport, utilize or dispose of solid waste shall take measures to prevent or reduce environmental pollution caused by solid waste, and shall be liable for the caused environmental pollution according to law. Article 6 The State promotes the household waste classification system. For household waste classification, the principles of government promotion, participation by all people, overall urban-rural development, adaptation to local conditions and simplicity shall be adhered to. Article 7 The people’s governments at various levels shall be responsible for the prevention and control of environmental pollution caused by solid waste in their respective administrative areas. The State implements the target responsibility system and assessment system for the prevention and control of environmental pollution caused by solid waste, and incorporates the completion of the prevention and control target of environmental pollution caused by solid waste into the assessment content. Article 8 The people’s governments at various levels shall strengthen the leadership over the prevention and control of environmental pollution caused by solid waste, organize, coordinate and urge relevant departments to perform their duties of supervision and administration over the environmental pollution caused by solid waste according to law. Provinces, autonomous regions and municipalities directly under the Central Government can negotiate to establish a joint prevention and control mechanism for environmental pollution caused by solid waste across administration areas, and make overall arrangements for formulation of planning, facility construction and solid waste transfer. Article 9 The competent department in charge of ecology and environment under the State Council shall exercise unified supervision and administration over the prevention and control of environmental pollution caused by solid waste throughout the country. The competent departments in charge of development and reform, industry and information technology, natural resources, housing and urban-rural development, transport, agriculture and rural affairs, commerce, health, customs and others under the State Council are responsible for the supervision and administration over the prevention and control of environmental pollution caused by solid waste within the scope of their respective duties. The competent departments in charge of ecology and environment of the local people's governments shall exercise unified supervision and administration over the prevention and control of environmental pollution caused by solid waste within their respective administrative areas. The competent departments in charge of development and reform, industry and information technology, natural resources, housing and urban-rural development, transport, agriculture and rural affairs, commerce, health and others of the local people's governments are responsible for the supervision and administration over the prevention and control of environmental pollution caused by solid waste within the scope of their respective duties. Article 10 The State encourages and supports scientific research in and development of technologies for prevention and control of environmental pollution caused by solid waste, promotes the wide use of advanced technologies for such prevention and control, and disseminates scientific knowledge in this field. Article 11 State organs, social organizations, enterprises and institutions, grass-roots mass autonomous organizations and news media shall strengthen publicity, education and scientific popularization for prevention and control of environmental pollution caused by solid waste, and enhance public awareness of prevention and control of environmental pollution caused by solid waste. Schools shall carry out the popularization of knowledge and education about household waste classification and prevention and control of environmental pollution caused by other solid wastes. Article 12 The people’s governments at various levels shall give awards to the entities and individuals that have achieved outstanding results in the prevention and control of environmental pollution caused by solid waste and in its multipurpose use. Chapter II Supervision and administration Article 13 The people's governments at or above the county level shall incorporate the prevention and control of environmental pollution caused by solid waste into the national economic and social development planning, ecological and environmental protection planning, and take effective measures to reduce the amount of solid waste, promote its comprehensive utilization and reduce its harmfulness, and minimize the amount of solid waste landfilled. Article 14 The competent department in charge of ecology and environment under the State Council shall, in conjunction with the relevant departments under the State Council, formulate the identification standards and procedures for solid waste and the national technical standards for prevention and control of environmental pollution caused by solid waste according to the national environmental quality standards and national economic and technical conditions. Article 15 The competent department in charge of standardization under the State Council shall, in conjunction with the competent departments in charge of development and reform, industry and information technology, ecology and environment, agriculture and rural affairs and others under the State Council, formulate standards for comprehensive utilization of solid waste.
